Acceptable Use Policy (AUP) for Presyakto

Welcome to Presyakto. This Acceptable Use Policy (“AUP”) governs the standards of conduct and acceptable content for all users of the Presyakto platform (“Platform”). By accessing or using our Platform, you agree to comply with this policy in addition to our Terms and Conditions, Return and Refund Policy, and Privacy Policy.
This AUP forms part of the Presyakto Terms and Conditions and Privacy Policy. It reflects our commitment to comply with applicable Philippine laws including the Internet Transactions Act of 2023 (Republic Act No. 11967), the Data Privacy Act of 2012 (Republic Act No. 10173), Department of Trade and Industry (DTI) regulations, and other relevant regulations governing electronic commerce, consumer protection, and data privacy.
1. Prohibited Items and Activities
You may not use Presyakto to sell, purchase, promote, or engage in activities involving:
Illegal goods or services, including but not limited to stolen, counterfeit, smuggled, or otherwise unlawful items as banned under Philippine law, regulations, and local ordinances.
Prohibited or restricted items such as:
Drugs, controlled substances, or drug paraphernalia
Weapons, firearms, ammunition, explosives
Hazardous materials or chemicals
Human parts, remains, or bodily fluids
Items infringing intellectual property rights as defined under the Intellectual Property Code of the Philippines and related enforcement laws
Pornographic or obscene materials prohibited by law
Live animals (except as explicitly permitted by law and Platform policy) Government-issued IDs, licenses, or official documents
Any other items banned under Philippine law or Presyakto policies
Fraudulent, misleading, or deceptive conduct, including:
False, misleading, or inaccurate item descriptions or advertising
Scams, phishing, or attempts to unlawfully collect user credentials
Listings or promotions constituting unfair, deceptive, or unconscionable acts or practices under Philippine consumer protection laws
Financial crimes, including money laundering, terrorist financing, or similar offenses.
Pyramid schemes, multilevel marketing, or get-rich-quick scams.
Any other activities or items deemed unsafe, harmful, or inappropriate at Presyakto’s discretion.
Presyakto complies with legal takedown requests and removes listings that violate applicable laws or platform policies in accordance with RA 11967 and DTI guidelines.
2. User Conduct
When using Presyakto, you must:
Treat all members of the community with respect, courtesy, and professionalism.
Not engage in harassment, discrimination, hate speech, or abusive behavior.
Avoid spamming, including repeated unwanted messages or unsolicited listings.
Not impersonate other individuals, businesses, or Presyakto staff.
Not attempt to manipulate ratings, reviews, or any platform feature.
Not circumvent platform fees, safeguards, or official dispute processes.
Respect data privacy laws and not collect, transmit, or misuse other users’ personal information without proper consent, consistent with the Data Privacy Act of 2012.
Follow all applicable laws and platform policies, including but not limited to the Internet Transactions Act, data privacy regulations, and relevant Philippine statutes.
Refrain from any abusive or fraudulent conduct including identity theft, phishing, and other cybercrimes.
3. Content Standards
Users are prohibited from uploading, listing, or sharing content that:
Contains threats, incites violence, or promotes illegal activity.
Is inappropriate, offensive, defamatory, or libelous.
Violates privacy rights, intellectual property rights, or misrepresents products or services.
Includes malware, viruses, or malicious code.
Violates laws related to obscenity, defamatory speech, or incitement under Philippine law.
4. Technical Restrictions
You may not:
Attempt unauthorized access to Presyakto’s systems, databases, or user accounts.
Use bots, scrapers, or any automated tools to harvest data or disrupt services.
Introduce malware, viruses, or other harmful software.
Attempt to disrupt the operation or security of the Platform, including denial of service attacks or hacking, which are strictly prohibited.
Such acts violate Philippine laws, including the Cybercrime Prevention Act (Republic Act No. 10175), and offenders may be held civilly and criminally liable. HelloWorld reserves the right to report any such activities to appropriate law enforcement authorities for investigation and prosecution.
5. Enforcement and Consequences
Violation of this AUP may result in:
Warning notices.
Delisting or removal of prohibited content.
Cancellation of orders.
Restrictions, suspensions, or permanent bans of user accounts.
Reporting illegal activities to the appropriate law enforcement authorities.
Cooperation with the Department of Trade and Industry (DTI), National Privacy Commission (NPC), and other relevant government agencies in investigating violations.
Any other action deemed necessary by Presyakto to protect the Platform and its users, without prejudice to criminal or civil proceedings under Philippine law.
6. Reporting Violations
If you encounter prohibited items, suspect fraudulent conduct, or have security concerns, please report them by:

For serious violations, users may also file complaints with the National Privacy Commission (NPC) or the DTI Consumer Protection Group.
We encourage all users to help maintain a safe and trustworthy marketplace.
7. Updates
Presyakto reserves the right to update this Acceptable Use Policy at any time. Updates will be communicated via the Platform and will take effect immediately upon posting.
This policy operates in conjunction with other Platform policies, including but not limited to the:
Collectively, these policies govern your use of the Presyakto services and commit you to follow all applicable rules and responsibilities.
Updates may be made to ensure compliance with evolving Philippine laws, regulations, and best practices. Continued use of the Platform signifies acceptance of any updates.
