Presyakto Prohibited Listings and Seller Investigation Policy

   1. Introduction
Presyakto is dedicated to providing a safe, lawful, and trustworthy online marketplace in compliance with Philippine laws including the Internet Transactions Act of 2023 (Republic Act No. 11967), the Data Privacy Act of 2012 (Republic Act No. 10173), the Consumer Act of 1992 (Republic Act No. 7394), the Intellectual Property Code, and related Department of Trade and Industry (DTI) regulations.
This policy applies to all listings and selling activities on Presyakto, whether by independent Sellers or Presyakto itself. It outlines the procedures for identifying, reporting, removing, and investigating prohibited, illegal, counterfeit, hazardous, or otherwise unlawful listings, as well as managing seller accountability while respecting data privacy and due process.
This policy operates alongside Presyakto’s Terms and Conditions, Privacy Policy, Acceptable Use Policy, and Return and Refund Policy. Users are expected to comply with all these governing documents.
   2.Reporting Prohibited Listings
Users, regulatory authorities, rights holders, and other stakeholders may report suspected prohibited or illegal listings by:
- Using the in-platform reporting tools.

Reports should include clear and specific information about the listing(s) in question, nature of the violation, and any supporting evidence. Where feasible, anonymous reports are accepted but providing contact information improves investigation efficiency.
Presyakto aims to acknowledge receipt of reports within 48 hours to the reporting party (if identifiable).
Examples of prohibited listings include but are not limited to illegal goods, counterfeit products, hazardous materials, fraud-related listings, and items banned under Philippine laws or Presyakto policies (see Acceptable Use Policy for further details).
   3. Immediate Action on Reported Listings
Upon receipt of a valid report, or if prohibited content is detected through internal monitoring, Presyakto will:
- Immediately remove, disable, or restrict access to the specific listing pending investigation, to prevent harm and comply with legal obligations.
- Take urgent takedown actions required by applicable laws or court orders, including RA 11967’s takedown procedures.
- Notify affected parties as appropriate.
- Invalid or malicious reports may result in sanctions against the reporting user, including account suspension.
   4. Seller Notification and Opportunity to Respond
Sellers whose listings are removed or restricted will be promptly notified via verified communication channels such as registered email or platform notifications. The notification will include:
- Details of the reported violation.
- Instructions and timeline (typically 5–7 calendar days) to submit clarifications, evidence, or counterarguments. Sellers may request a reasonable extension if needed.
Failure to respond or cooperate may result in further enforcement actions including suspension or termination of accounts.
   5. Investigation Process
Presyakto commits to a fair, thorough, and timely investigation that involves:
- Reviewing all relevant evidence including reports, seller submissions, and internal data.
- Verifying compliance with platform policies and Philippine laws governing e-commerce, intellectual property, consumer protection, and safety.
- Considering context to distinguish inadvertent errors from deliberate violations.
- Consulting legal counsel or authorities as necessary while adhering to confidentiality and data privacy duties under RA 10173.
- Documenting investigation steps and rationales.
   6. Seller Account Actions
Depending on investigation outcomes:
- First-time or minor violations:
Sellers receive warnings with guidance to rectify issues; listings may be reinstated upon compliance. - Serious, repeated, or unaddressed violations:
Presyakto may suspend or permanently terminate seller accounts and remove related listings to protect users and platform integrity. - Intellectual Property Rights Violations:
Such cases may involve coordination with rights holders and referral to legal authorities. - Withholding payments or commissions:
If applicable, payments related to disputed listings may be withheld pending resolution.
Presyakto reserves the right to take immediate protective actions to prevent harm without prejudicing legal remedies.
   7. Documentation and Recordkeeping
All reported cases, investigation records, seller communications, and enforcement outcomes are documented and securely stored consistent with data privacy laws and retention requirements.
Access to investigation data is limited to authorized personnel only.
   8. Cooperation with Authorities
Presyakto cooperates fully and lawfully with:
- The Department of Trade and Industry (DTI)
- National Privacy Commission (NPC)
- Law enforcement agencies
- Other regulatory bodies
when investigating unlawful marketplace activities, providing information as permitted by law while safeguarding privacy rights.
   9. Appeals
Sellers may appeal enforcement decisions by contacting Presyakto through designated support channels within the timeframe specified in their notification (generally 7 calendar days from decision).
Appeals are reviewed by a designated Appeals Officer or Committee. Decisions on appeals are final and binding.
Filing an appeal does not automatically reinstate suspended accounts or listings unless explicitly stated.
   10. Commitment to User Safety and Platform Integrity
Presyakto prioritizes maintaining a marketplace free from illegal, unsafe, or fraudulent goods and practices. We commit to:
- Swift, fair action on reported violations.
- Regular monitoring and preventive measures.
- Educating users to promote safe participation.
- Ensuring alignment with Philippine consumer protection and e-commerce laws.
